These Terms and Conditions set out the basis on which House Clearance Dulwich provides house clearance and waste collection services. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
In these Terms and Conditions, the following definitions apply:
1.1 Service means any house clearance, waste removal, rubbish collection, bulky item removal, or related service provided by House Clearance Dulwich.
1.2 Customer means the individual, business, landlord, agent, or organisation that books or receives the Service.
1.3 Premises means the property or location where the Service is to be carried out.
1.4 Waste means items, materials, furniture, appliances, or other goods that the Customer wishes to dispose of through our Service, subject to applicable waste regulations.
1.5 Agreement means the contract between House Clearance Dulwich and the Customer incorporating these Terms and Conditions, any quotation provided, and any written confirmation of booking.
2.1 House Clearance Dulwich provides house clearance and waste collection services, including the removal of household items, general rubbish, and certain commercial waste, subject to applicable regulations.
2.2 The precise scope of the Service will be as set out in the written or verbal quotation and confirmed at the time of booking. This may include the number of collection operatives, vehicle capacity, and anticipated volume or weight of Waste.
2.3 The Service does not include specialist hazardous waste removal, such as asbestos, clinical waste, chemicals, or any materials that require specialist licences or equipment, unless expressly agreed in writing in advance.
2.4 House Clearance Dulwich reserves the right to refuse to remove any item that, in the opinion of its staff, is unsafe to handle, prohibited by law, or not included in the agreed Service.
3.1 Bookings may be made by telephone, email, or other contact methods specified by House Clearance Dulwich.
3.2 To make a booking, the Customer will be asked to provide details including:
(a) Name and contact information
(b) Address of the Premises
(c) Description of the items or Waste to be removed
(d) Access information and any parking or loading restrictions
(e) Preferred dates and times for the Service
3.3 Any quotation provided prior to visiting the Premises is an estimate based on the information supplied by the Customer. The final price may be adjusted on site if the volume, weight, or nature of the Waste differs from that described at the time of booking.
3.4 A booking is not confirmed until House Clearance Dulwich has acknowledged acceptance of the booking and provided a date and time window for the Service.
3.5 The Customer is responsible for ensuring that all information given at the time of booking is accurate and complete. House Clearance Dulwich shall not be liable for delays or additional costs arising from incorrect or incomplete information.
4.1 The Customer must ensure that House Clearance Dulwich staff have safe and reasonable access to the Premises at the agreed time, including any necessary access codes, keys, or instructions.
4.2 The Customer is responsible for arranging suitable parking or loading space for our vehicles and for paying any parking charges or permits required, unless otherwise agreed in advance.
4.3 If suitable access or parking is not available at the time of arrival, House Clearance Dulwich may charge a waiting fee, an additional fee for extended carrying distance, or cancel the Service and apply a cancellation charge.
5.1 The Customer must ensure that:
(a) Items to be removed are clearly identified and accessible
(b) Any items not to be removed are segregated where reasonably possible
(c) The Premises are safe for our staff to work in, free from hazards such as exposed wiring, structural instability, or aggressive animals
5.2 The Customer warrants that they are the owner of the items to be removed or have full authority from the owner to request their removal.
5.3 The Customer agrees to indemnify House Clearance Dulwich against any claims from third parties alleging that items were removed without proper authority.
6.1 Quotations are based on information supplied by the Customer and are usually calculated by reference to volume, weight, the nature of the Waste, access conditions, and distance from the vehicle to the Waste.
6.2 Where a site visit is carried out and a fixed quotation given, the price quoted will be binding unless the scope of work changes or additional Waste is presented on the day.
6.3 If on arrival the Waste is substantially different from that described, House Clearance Dulwich reserves the right to adjust the price or decline the work.
6.4 All prices will be communicated inclusive or exclusive of VAT as applicable under UK law. The Customer will be informed of any applicable taxes at or before the time of booking.
7.1 Unless otherwise agreed in writing, payment is due on completion of the Service on the same day.
7.2 Payment may be made by cash, card, bank transfer, or other methods as communicated by House Clearance Dulwich from time to time.
7.3 For business and account Customers, alternative payment terms may be agreed in writing. Where credit terms are offered, payment shall be due within the agreed period from the date of invoice.
7.4 If payment is not received when due, House Clearance Dulwich reserves the right to charge interest on the overdue amount at the statutory rate allowed under UK law, as well as any reasonable costs incurred in pursuing the debt.
7.5 House Clearance Dulwich retains ownership of any items reclaimed for resale or recycling as part of the Service, unless otherwise agreed in writing.
8.1 The Customer may cancel or reschedule a booking by giving at least 24 hours notice prior to the agreed arrival time.
8.2 If less than 24 hours notice is given, House Clearance Dulwich reserves the right to charge a cancellation fee, which may be up to 50 percent of the estimated Service price.
8.3 If the Customer is not present at the Premises at the agreed time and has not provided access arrangements, this may be treated as a late cancellation and a fee may be charged.
8.4 House Clearance Dulwich may cancel or reschedule the Service if it is prevented from carrying out the work due to circumstances beyond its control, including adverse weather, vehicle breakdown, staff illness, or safety concerns. In such cases, any prepayments will either be refunded or applied to a rescheduled booking.
9.1 House Clearance Dulwich operates in accordance with applicable UK waste management and environmental legislation and will transport and dispose of Waste only at authorised sites.
9.2 By using the Service, the Customer confirms that the Waste is of a type that can lawfully be collected and disposed of through a general house clearance and waste collection service.
9.3 The Customer must inform House Clearance Dulwich in advance if any Waste is hazardous or requires special handling. House Clearance Dulwich may refuse to collect such Waste or may agree alternative arrangements at additional cost.
9.4 House Clearance Dulwich may separate and divert items for reuse, recycling, or recovery where possible, in line with waste hierarchy principles, but does not guarantee that any particular item will be recycled.
9.5 Upon request by the Customer, and where applicable, House Clearance Dulwich may provide evidence of lawful disposal such as a waste transfer note or similar documentation, in line with regulatory requirements.
10.1 House Clearance Dulwich will exercise reasonable care and skill in providing the Service.
10.2 The Customer is responsible for ensuring that only items intended for removal are taken. The Customer should check the Premises before and after the clearance to confirm that no personal or valuable items have been taken in error.
10.3 House Clearance Dulwich shall not be liable for any loss of or damage to items that the Customer did not clearly identify as not to be removed.
10.4 If House Clearance Dulwich is found liable for loss or damage, its liability shall be limited to the reasonable cost of repair or replacement of the affected item, taking into account fair wear and tear, age, and condition, and shall not exceed the total price paid for the Service.
10.5 House Clearance Dulwich shall not be liable for:
(a) Indirect or consequential loss, such as loss of profits, business, or opportunity
(b) Loss or damage arising from inaccurate information provided by the Customer
(c) Pre-existing damage or structural defects at the Premises
(d) Damage to items that are already fragile, poorly constructed, or not suitable for transport
10.6 Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under UK law.
11.1 House Clearance Dulwich maintains appropriate public liability and employer liability insurance in connection with the provision of its Services.
11.2 Details of insurance cover may be provided to the Customer upon reasonable request.
12.1 If the Customer is dissatisfied with any aspect of the Service, they should notify House Clearance Dulwich as soon as possible, preferably within 48 hours of completion of the work.
12.2 House Clearance Dulwich will investigate any complaint and may request photographs, supporting information, or an opportunity to inspect the Premises.
12.3 Where a complaint is upheld, House Clearance Dulwich may, at its discretion, offer a partial refund, price reduction, or a return visit to remedy the issue where reasonably possible.
13.1 House Clearance Dulwich will collect and process personal data only for the purpose of providing its Services, managing bookings, issuing invoices, and complying with legal obligations.
13.2 Customer information will be handled in accordance with applicable UK data protection laws.
13.3 House Clearance Dulwich will not sell or share Customer data with third parties except where necessary to provide the Service, recover debts, comply with legal requirements, or where the Customer has given consent.
14.1 House Clearance Dulwich shall not be in breach of this Agreement nor liable for delay or failure to perform its obligations if such delay or failure results from events, circumstances, or causes beyond its reasonable control, including but not limited to acts of God, flood, fire, epidemic, strikes, or transport disruptions.
15.1 House Clearance Dulwich reserves the right to amend these Terms and Conditions from time to time.
15.2 The Terms and Conditions in force at the time of the Customer's booking will apply to that booking, unless a change is required by law or regulatory authority.
16.1 These Terms and Conditions and any Agreement arising from them shall be governed by and construed in accordance with the laws of England and Wales.
16.2 Any disputes arising out of or in connection with the Service or these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
17.1 These Terms and Conditions, together with any written quotation and booking confirmation, constitute the entire Agreement between House Clearance Dulwich and the Customer and supersede any prior understandings or agreements, whether written or verbal.
17.2 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
18.1 The Customer may contact House Clearance Dulwich using the contact details provided on its communications or advertising materials for matters relating to bookings, payments, complaints, or general enquiries.
By confirming a booking and allowing the Service to proceed, the Customer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
